Acceptance of Terms

By accessing or using Nagan.ai (the "Platform"), you agree to be bound by these Terms and Conditions. These terms apply to all visitors, users, and others who access the service globally.

• Credit Expiration: All credits purchased or allocated to an account are valid for a period of 30 days from the date of purchase/allocation.

• No Carry Forward: Any unused credits at the end of the 30th day will automatically expire and will not be carried forward to the next billing cycle or month. It is the user’s responsibility to utilize credits within the validity period.

• Final Sale: All payments made to Nagan.ai are final.

• No Refunds: Due to the digital nature of the service and the immediate allocation of resources, we do not offer refunds under any circumstances (including but not limited to unused credits, dissatisfaction with AI output, or accidental purchases).

• Nagan.ai just provides a platform for generating Audio, Video, and Image content.

• User Liability: The User (the "Brand" or individual) assumes sole and exclusive responsibility for all content generated using the Platform.

• Compliance: You represent and warrant that your use of generated content complies with all local and international laws, including copyright, trademark, and defamation laws.

• No Platform Monitoring: Nagan.ai does not pre-screen or monitor generated content and is not responsible for any offensive, illegal, or infringing material produced by users.

• To the maximum extent permitted by applicable law, Nagan.ai, its founders, and employees shall not be liable for:

• Any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the platform.

• Any errors or inaccuracies in the AI-generated output.

• Any loss of data or profit arising from service interruptions.

• The platform is provided on an "AS IS" and "AS AVAILABLE" basis.

• Users agree not to use the platform to generate content that:

• Promotes hate speech, violence, or illegal activities.

• Infringes on the intellectual property rights of third parties.

• Depicts non-consensual sexual content or deepfakes intended to harass or deceive.

• These terms shall be governed by the laws of the jurisdiction where Nagan.ai is registered, without regard to conflict of law provisions. Users are responsible for compliance with their local laws.

• Right to Terminate: Nagan.ai reserves the right, at its sole discretion, to terminate or suspend any account immediately, without prior notice or liability, for any reason whatsoever.

• Illegal Activity: This includes, but is not limited to, the detection of illegal activity or the generation of content that violates third-party rights (Copyright, Trademark, Privacy, etc.).

• Complaints: If Nagan.ai receives a formal complaint or notice regarding content generated by a user, we may terminate the account without prior communication.

• No Compensation: In the event of termination due to a violation of these terms, the user forfeits all remaining credits and no refunds will be issued.

• You agree to defend, indemnify, and hold harmless Nagan.ai and its employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt (including attorney's fees) resulting from:

• Your use and access of the Service.

• Content generated by your account that affects or harms a third party.

• A breach of these Terms.

• The brand/user is the "Publisher" of any content created via Nagan.ai. You acknowledge that Nagan.ai acts strictly as a technical service provider. You are liable for ensuring that any Audio, Video, or Image generated does not infringe upon the rights of others. Nagan.ai is not responsible for any legal disputes arising from user-generated content.
